Depends on what the prenup says.If it says he gets to keep all he had before  he married then he gets to keep it.The rest is community property.

If you have a prenuptial agreement, the money he had when you got married is probably still his. Get an attorney. They know a lot more about these things than those of us who use YA. If you can't afford on, go to legal aid. Good luck.
