I have a auto insurance check?

But it has the auto body shops and then my name on it can i cash it with out the body shop signing it but if they have to how do i get them to sign it.

  1. The check you probably have is the actual cash value of the policy.  The rest is waiting till the repairs are done.  If you told the adjuster that you wanted a company to do the work they will issue the check in both names.  You can ask to have the check reissued in just your name, but be aware that you are leaving money on the table.  Your car will be depreciated if you take the payout and will actually suffer greater loss to do so.  I suggest you look at all options before making your decision to get the check reissued.  Good Luck


  2. .......chances are that they made the check out to you and the bodyshop because the bodyshop did repairs to your vehicle or will be doing repairs to your vehicle based on an estimate.

    The insurance company in this case must be YOUR insurance company.

    If you have a lien (loan from a bank) on your car - the insurance company is required to protect the bank's interest the vehicle.  They can do that by issuing the check to you and the bodyshop.  

    Usually, the bodyshop will have you sign off on the check when the repairs are done and then THEY will cash the check.

    If you don't want the bodyshop on the check - you can ask the insurance adjuster to reissue it - but they will reissue it to you and the bank.  (that is - if you have a loan).

    If you don't have a loan - show the adjuster the lien free title and they can issue the check to the titled owner of the vehicle.

  3. No, you can't.  You can ask the adjuster to re-issue the check, and then it will be in you name, and the bank that your loan is through.

I know you can deposit it into your bank, because I work at a law office and when the checks come in to the client and the office, we get the client to come in to sign.  Becuase if we mail them the check, they would be able to deposit it.  Now, cashing... I'm not sure... but it might be the same.  At a cashing place, they might ask for ID, and if your name's on the check, why would they say no?
