I have a bro in afghanistan and the army people came to my house saying he is in germany.?

and write now he is going to be coming home on september 9th they are discharging him because they said he is a mental danger and he went AWAL now wtf does that mean and how can my family press charges?

  1. You can't press charges.  Your brother went AWOL, which is know to all SM as a crime punishable by the Uniform Code of Military Justice.  How the h**l do you go AWOl in Aftganistan?  Like he had many places to hide.  since he is a mental danger, he might get out with a disability.  If he is mentally dangerous, he doesn't need to be in the Army, especially over there...he is better off.  Take care of your brother.  I hope he can get over this.


  2. Your family can't press charges. If he went AWOL, that means he left without authorization. If they determined that he is mentally unstable then they can discharge him.

  3. AWOL is a military term that means he was "away without leave" which means he left on his own and without the army's permission. He has some mental problems, which might be traumatic stress or something else. He will need a doctors and therapist's help to get better. Be supportive when he gets home, and see if he wants to talk about his experiences with you. Help your Mom with anything she needs to do to get ready for his return home. Your family can not press charges, and it sounds like the army will not press charges against your brother. Germany is one of the army's central transport bases for processing before the soldiers return home or before the soldiers go to other army bases overseas.

  5. your family cannot press charges..and why on earth would you think you were entitled to.  your Brother prolly has a PTSD and is no longer capable of functioning in the Army.  It happens.  heck, my cousin just escorted somebody from Iraq to Germany because he went  crazy in the field.  

    going AWOL(Absent without Leave)means your brother deserted his post and failed to do his duty.  he can have charges pressed against HIM for doing so, especially in a combat zone.

  7. Are you sure they`re real personnl and are not faking?All military personnel require a status check(Leave form,memorandum of approval etc) before acquiring a ticket.Somebody with a mental illness getting through all of that?Well..


  8. There is nothing to press charges for. They informed you that your brother went AWOL (absent without leave, also known as UA, unauthorized absence, and that he has some mental illness, sounds like some kind of break from reality. They have deemed him no longer fit for service, they will ship him home and discharge him. I don't understand how there has been a chargeable crime committed.

    If he went AWOL in a time of war, it's called desertion. And they used to hang you for it.

    My guess is that he'll be returned and charged. If it was not a desertion, he'll likely be discharged Dishonorably or at the very least Other Than Honorable (Medical).

    Since they brought up mental danger, I'd assume it was OTH. Hopefully they'll take pity on him and assign him counseling.

    But your family has no capacity to sue the military. He'll be lucky if they determine he's just crazy and not subject to the crime of cowardice under the USMJ.

    That means he left his post or duty station and disappeared without letting anyone know his situation, he was found or turned himself in and is now in germany at a military base awaiting travel home.

    He's probably under alot of emotional stress and just wanted to get out, hence them saying he's in mental danger.

    Your family cannot press charges because he was most likely aware of the situation he's in. He voluntarily went AWOL.

    Being he was in afghanistan, he's probably facing charges of his own for going AWOL. This could mean he could get kicked out of the military and serve jail time in a military prison for it.

    Hopefully he at least has a General under honorable discharge.

    Otherwise the most you can do is find a military lawyer and petition for his discharge to be upgraded and fight for benefits.
