I have a child support question for Virginia............?

The custodial parent has allowed this child to quit school in the 9th grade and the child has a baby. By her being out of school and a child of her own what is her fathers obligation as far as child support?

Normally a child having a child will not change anything.  The child that the support is being paid for has to be legally emancipated.  And her simply having a baby of her own will not do that automatically.  The fact that she quit school also has no bearing on when the support stops right now at least.  Here this is straight from the VA laws.

    "Support will continue for any child that is a full-time high school student, not self-supporting, and living in the home of the parent, until the child reaches the age of nineteen (19) or graduates from high school, whichever comes first. Support terminates when the child turns 18 if the child is not in high school "

    So using the fact that she quit school at age what 14 or 15, will do nothing.  If she quit school at age 18, then the non-custodial could use that as a reason to stop the support sooner.  But since she is still living at home with the custodial parent the support will continue until at least age 18.  Now once the daughter moves out of the custodial parents house prior to age 18, then the support can be stopped.  But as of right now, things will stay the way they are as far as the non-custodial is concerned, & the daughter will probably have to go after child support from the father of her baby too.  I hope that helped a little.
