I have a collection agency bugging me for a debt...?

...that is 8 or 9 years old from a previous landlord. It is on my credit report and preventing me fom getting credit. What can I do?

  1. If the user didn't pay the debt, then it can stay on his credit report until he pays it off +7 years.

    Let's say it's been on there for 7 years, but he hasn't paid i t. Then he pays it tomorrow, it can stay on his credit report for seven more years. It is removed from your credit report seven years from when the debt is removed.

    Your best bet is to pay it and wait a year or two or three and try for a credit card then.

First off it looks like it is past the statute of limitations.  So you need to write them and the and letter telling them this debt is no longer valid.  Go to creditboards.com, they have sample letters there you can send to them.  Also if they do not remove the debt from your report dispute with the Credit Report Agencies.  It seems like it is past the 7 year reporting period.  Write them and telling them this (also sample letter for this are at the above mentioned website) and to please remove it fromyour reports.  If it is not past the 7 years, use the method found here to dispute neg. on your report. http://www.creditforums.org/f13/got-my-r...  I just diputed a bunch of neg on my credit report and had good success with that method.  All the above sites are free and you do not have to sign up for anything

  4. Seven years is the maximum allowable time to stay on a credit report.  If this is a judgment, the judgment remains on a consumer's credit report for 7 years from the "date of entry, or until the governing statute of limitations has expired, whichever is longer".

    Send a certified letter + return receipt to all three credit bureaus stating: Per the Fair Credit Reporting Act,  I am requesting validation that this item is being reported within the seven year allowable time frame as allowed under the Fair Credit Reporting Act.  

    Send another certified letter + return receipt to the collection agency stating:

    Per the Fair Debt Collection Practices Act, I am requesting written validation of this alleged debt and that said debt is within the statute of limitations.
