Question:

I have a collections account...It's on my husband's credit!!! HELP?

I have 2 accounts in collections. They are already on my credit report and have been for about 2 years but they have also have reported my husband even though they are my accounts. So these are on his credit now too..They are medical bills and I was the patient not him. He has sent the collection agency a letter to validate the debt but they did not have a response. They have only sent back an invoice of the amount that is due. Can they do this??

I will pay these but I want them to remove them from his credit since it is better than mine.

  1. KKup has no idea what he is talking about. Basically everything in his answer is wrong.

    While it's true that sometimes (not all) in community property states that the spouse can be held responsible for debts incurred during marriage, this doesn't mean they can list the debt on his credit report.

    If the invoice they sent has your name on it, your husband can send a copy of that to the credit bureaus as a dispute and likely have it removed.

    If the account is not removed from his credit report soon, send a 2nd letter giving them 15 days to remove the listing or your next communication to them will be in the form of a summons. What they are doing is a major violation of the FCRA and they can be sued, along with the credit bureaus if they allow this debt to continue being reported. To top it off, you can also file complaints with the BBB, and the attorney generals in both your state and the collection agencies.

  2. You are married.  They can do this.

    You own the debt together if you were married at the time that the debt was incurred.  

    If you didn't want to share the burden of debt, you shouldn't have gotten married.   It is part of the deal...

    For better, for worse... richer poorer...

    Sorry, but you can't get it off his credit until you pay it.

  3. You can try to get it deleted off his and your credit without even paying it off. If you alredy got your credit report you should have a form to investigate accounts. Fill that form out on either Experian or Equifax with them two accounts to investigate. Check the box that states its not your account. On the side its gona have space for you to explain why its not your account or whos account is it. Fill in either I dont know or maybe another family member dont be specific. When they investigate they gotta get a hold of the collection agency or medical center the bill belongs to. If they dont get a hold of them or if the medical o collection agency doesnt get back to the credit agency it will get deleted off your credit and can never get put back on. You can do it to any other accounts you dont want. I got out of about $15,000.00 in collection. Its depends on if they catch it or not. Give it a shot im sure it will work. Good luck.
