  1. If you own them, you can cash them in.

    But often, cashing in a CD comes with penalties and loss of interest.  If possible (you don't NEED the money immediately), it would probably be better to wait until it fully matures.  You get more money that way.


  2. You need to check with the bank.  It's possible that they waive any surrender period (penalty) if the owner has died.  

    However these questions are more important:

    Are you the beneficiary of his will or are you named in it as the beneficiary of these CD's?  Or are you the named beneficiary on the CD's?  If the answer is no to all of these, you cannot cash them in.
