Question:

I have a debt still on my credit report that is past the statutes of limitations. How do I get rid of it?

It has been more then 7 yrs and way past the SOL. I plan on writing to the credit agencies and requesting that it be removed. I was just wondering if there is certain way to do it? Like, what kind of information do I need to give them? Any special wording or legal mumbo jumbo I should include? Please help. I'd like to take care of this ASAP!

  1. Derogatory items should age off 7-1/2 years from the date of first deficiency.  This is generally about a month after your last payment or services were provided.  If the debt is beyond the reporting period based on this, dispute the item with the credit bureau.  Be sure to refer to it as "reporting period" not Statute of Limitations (SOL).

    Although technically the 7-1/2 reporting period is a Statute of Limitations, most people think of the SOL as the timeframe to bring lawsuit.  An item can be past the SOL but still within the reporting period.

    Be clear and concise in your communications. Don't reference a bunch of quasi "legalese" thinking that will get faster action.


  2. Contact the credit bureau and dispute it.

    They will do research and see it's past the SOL and will delete it. I'm constantly have to dispute things on my report after the SOL.
