Question:

I have a failure to appear in court in Colorado, but live in South Carolina... is there any way to get out?

i do not want to get arrested but cannot afford to just go back. i really do not know what to do.

  1. No, if you dare get stopped for speeding and they run your name, social and DOB there will be a warrant in the system.  Depending on the FTA for the bench warrant, the return might be "non-extraditable" of course murder, rape and some other infamous crime you are toast.


  2. Is there anyway you can get a court appointed attorney to represent you?  He might be able to take care of things for you in Colorado but just not showing up isn't good.  I would call the court house and tell them the situation and try to find an attorney.

  3. This all depends on what you were originally charged. Usually, FTA warrants are for misdemeanors. Basically you did not show, were tried in your absence, found guilty and now you have to pay the original fine(s) and in some cases  FTA carries it's own fine. So by not appearing, you may have just increased the amount you owe. You can probably pay all these fines directly through the Clerk of Court in the jurisdiction you were arrested/ticketed in. Often the Clerk can work out a payment plan (not always though). I've seen some courts that take credit cards. Ask for payment options, it can't hurt. Just don't default on whatever you get set up, then you go back to square one.

    If this is something more serious, you need a lawyer. Especially if you were given jail time as a sentance.

    At any rate, if you get pulled over or stopped by the police the hit on your name will show the FTA warrant. Depending on the seriosuness of the original charge (Robbery, murder, etc), you may be extradited. Whatever you do, don't lie or try to decieve the LE Officer. Odds are you will get caught and just add to your problems.
