I have a friend and he has pleaded guilty to afray when it was not his folt can he change his plea ?

hi there his girlfriend is a ***** she is a drug user and in her statment she says she doesnt use drugs that is a lie. the story is they went the park with the kids she has 3 they r not his but he loves them as his own . they had bin split up 4 about a month but they all went out and came bk to her house after a lovely day out and he was sittin on the couch the two little ones where in bed and the eldest was upstairs. she asked him to go the chip shop as she neva has food in and he allways supplyes the kids with what they need but he said no 4 once and she flipped and told him to get out he said why you bein like this we have ahd a nice day dont spoil it and she told his to go with his couch he said dont b stupid where am i ament to put it she said if you dont take it am goin to cut it up so he said no your not its mine i payed 4 it so al cut it not you so he went in the kithen and got a knife and cut HIS couch up and she flipped and phoned the police and said he was goin 4 her with a knife when that was not the case she has made him out to be someone he is not a realy want to help him but dont no what to do he has bin told to expect 2 and a half years and his soliceter has not done his case any justic she just told him to plea guilty and he did what can a do to help can he change his plea when he is jue in court a week monday please help

  2. So, the guy cuts up his own couch and pleas guilty to trying to kill his crack w***e of a girlfriend when that's not what he was trying to do.  Whether or not you want to help him doesn't matter because you can't really help someone that screwed up.  

    On the other hand, you could try talking to the judge about what you witnessed.  Eitherway, I don't think the judge is going to take his behavior lightly.  He made the wrong decision in pulling out the knife.  He should've call the cops when she threatened to destroy his couch, but instead, he went into self-destruct mode.

  3. He should not get 2.5 years for this, it is a simple domestic case. The weapon she is going to say was threatened to be used against her, that is the problem. I need to know what he was charged with to try to give you some advice.

    The key to all this is to play nice with the nutty ex and have her tell the truth, recant. That or she can drop her poriton of the charge and hope that the state does not pick it up.

    The kids being in the house is what really did him in, he probably got risk of injury to a minor.

Your friend is really messed up.  Why would any adult man in his right mind cut up a couch for ANY reason?  He can change his plea but it is up to the judge as to whether or not he will accept the change.  He sounds every bit as crazy as his girlfriend.  Guilty or not it was pretty stupid of him to plead guilty.  He needs a lawyer because he doesn't seem to have a working brain.
