I have a friend who needs help regarding her immigration status?

she is a 22 year old girl who is attending community college and is not planning on getting married anytime soon..she has a younger brother the age of 19 i believe who was born here and she wants to know if there is a way she can ask for a green card or just be able to work..she has been in the u.s.a since the age of 3 or 4.

  1. If she is here illegally,there is no way to change her status without leaving the country and filing the proper paperwork from her home country.

    Her brother cannot petition for her until he is 21 and can prove that he can support her. Even then she would have to be out of the country and it would take years till it went through.

    Since she is over 18,the decision to remain here illegally is hers. She can no longer use the excuse that she was brought here by her parents as a minor. She can be deported at any time.


  2. Nope.  She is an illegal alien and needs to go back to her own country.  She can then apply to come back legally.

    I thought a social security number was needed to register at a community college.  

    She should thank her parent for putting her in this situation.

  3. What country is she from? If she's here illegally, she has to contact the Immigration and Customs Enforcement people (ICE), and apply for legal immigrant status. How is she attending any college without a social security number? She certainly won't be able to get a job without one.

  4. Her younger brother can possible petition for her since they are relatives. He would have to file the I-130, Petition for Alien Relative.

    Then she can file the I-765 which is the Application for Employment Authorization (http://www.uscis.gov/portal/site/uscis/m...

    If all goes well she will eventually have to submit form I-485, Application to Register Permanent Residence or Adjust Status, which she can do concurrently with the I-130 which will waive the fee of the I-765!!

    But!! Since she's been here illegally, chances are she won't be able to do much.
