Question:

I have a great idea and would like to patent it but...?

Can I just patent the idea or do I need to have the design of the product? It is a technology and mechanical related item and I don't know anything about either! I know this idea will work and I am pretty sure it's not out there but I don't know where to start or who I can trust? Any suggestions?

  1. The best place to start is to see a Patent Attorney

  2. You'll need to be able to show how your idea can be implemented, so you will need to be able to "flesh out" your idea.

You'll also want to be careful not to reveal the idea to people. You'll probably want to restrict the discussion to a reliable patent attorney that you have hired.

Check out http://www.patentengineers.com  It explains how to apply for a patent, and what kind of detail is needed in a patent.

  3. The idea must have some detail behind it.

A patent via a patent attorney will cost $6,000-10,000. Part of the patent process will be an investigation of similar items called a patent search. After your patent is issued you can then begin producing your item safely. The patent office will further research if there are conflicting patents.

At some point you may need to hire people to make a prototype unit. These vendors all will need to sign a confidentiality agreement indicating they will not disclose the nature of your item or use it for their own gain.
