Question:

I have a green card to live in america, but my boyfriend does not, if we got married could i sponser him?

i have had a green card to america for over 2 years now. i have been with my boyfriend (now my fiance)for nearly 4 years. we want to live in america together but obviously he has no rights to. if we got married i know i am eligible to sponsor him. what i am unsure of is whether this is the case as we were not already married when i got my green card. will it still be ok to sponsor him even though we will be getting married after i got my green card?

any advice from american immigration attorneys would be greatly appreciated!!!!! (i know I'm pushing my luck!!!) just any advice is welcome thank you

  1. Yes you can sponsor him but it will take a few years. He is supposed to remain out side the country until his application is approved so it won't get him here any quicker. And it will cost some money everything does.

If you have sufficient income and assets to support him and guarantee a $30,000 bond, you can marry and file an application for a spousal visa with the affidavit of support.  However, since you are a green card holder, not a citizen, you cannot get him priority to enter the US.  Therefore, he must wait in his own country while the application is processed.  It will take 5 years or more before he can enter the US.  

  3. Yes, you can sponsor him.  However, his immigrant visa (spouse of green card holder) has a quota.  It will take about 5 and 1/2 years before he can join you here.


  4. If you sponsor him now, you have to wait for 5 years. If you wait for 3 years, you can become American citizen and then it is easier and faster (less than 1 year) to bring him over.
