I noticed that a question was posted about Eric M. Berman P.C. I also wondered about legitimacy. This "law firm"initiated the lien on my account; and before the situation became difficult, I asked his representatives to send me a statement indicating my payments and balance. They stated that they were a legal firm and were unable to do so. I thought that their response was odd and indicated that I needed to know more about them. Now I have a freeze on my bank accounts. What can I do?

  1. In order to attach your bank account, there should be a judgment against you. Check your credit report to see if there is a judgment.  Contact the court to get a copy of that judgment.

If you were never served, you might be able to get the judgment set aside but you will need an attorney to do so.

This could be a case of a zombie collector suing after the Statute of Limitations (SOL) expired and getting a default judgment.  Or it could be a judgment from long ago and they finally found something to attach.
