I have a neighbor who calls the police and they discuss disturbing the peace issues...

I have a large household, we constantly have people over, enjoy our driveway and rear deck area. I have had the police called on me over 20 times w/in the last 5 years. This last instance, the police said I was disturbing the peace. The City has a noise ordinance of 8 pm, the event occurred at 6:30 PM. I need some assistance because I went to talk to the neighbor and things didn't go well at all after he threatened me of trespassing on his property. Help please so I can protect my property rights.

  1. as long as you dont make noise after 8:00 or as the law says, they can't legally do anything to you, and as far as the neighbor goes, as long as you aren't breaking any laws and there isn't a no trespassing sign, the police can't do anything unless you refuse to leave his property.


  2. And those 20 or so times the police has only given you warnings, right? Nothing's going to happen to you, because no matter how many times they call the police, they won't be able to do anything. You're not breaking any laws, the police shows up because they HAVE to. The police really couldn't give a rat's butt. As long as you're not firing guns in the air and blasting music at 1 AM there's nothing they can do except dial 9-1-1.

  3. wow that is why i dont' have neighbors close and that is why i would never live near someone. people are nerds sometimes and that is 630 which isnt' close to 8pm generally its 10 pm. well anyhow if youc an talk to them try and be nice if not i would just make sure you aren't in his property if they do on yours call the police it won't make it right but turning other cheek isn't good either you have rights and they have to obey also.

  5. We had a neighbor like that. What we did was to make a flier stating everything bad about her that was truthful and put them on every windshield in a four block area. She stopped her foolish behavior.

  7. It doesn't sound like you will be able to solve this amiably. If you do not have some type of ombudsman you will need to contact a lawyer.  You should avoid any further personnel contact with your neighbor.  If you do not want to contact a lawyer you should ask the police what you can do.  This should be a visit to the police station not when they come to your door to ask you to quiet down.

  8. The next time the police come over ask if this neighbour is a serial complainant. If he threatened you for trespassing when you went to his front door to talk to him, he's probably a Crazy that calls the police every day. If he has never complained about anyone but you, get him to keep complaining, but always turn your music down a little after you get the feeling he's probably called the cops. Time after time the cops will show up, see that you're just hanging out, and have to go give the guy **** for being a whiner. Cops DO keep track of serial complainants.

  9. Noise ordinances are in place for very specific reasons. To maintain the peaceful habitation that we are all entitled to as residents of this country. But, just as your neighbor is afforded this right so are you. What your neighbor is doing is borderline harassment. If your neighbor is imposing himself on your rights it's not legal. I'm surprised the cops get involved as much as they do. They can 'ask' you to quiet down before the imposed noise ordinance, but they can't force you to do anything on your property before then. If I were you, I would contact a lawyer through the bar association. Call 411 and ask for the number of your local bar association and call them and explain the situation. They will refer you to a lawyer in your area that specializes in these types of disputes. Also you can ask for one that offers free consultations. You'd be surprised at how much free legal advice you can receive through a free consultation.

  10. Next time you have one of your block parties, invite an attorney.. That way when the cops show up they can have a battle of who know more about the law. Not only does it make for good entertainment, you will find that the police wont be so quick to crash your party.

  11. First of all, the police shouldn't be saying anything since you didn't the pass the "noise" curfew.  I say you should go hire a lawyer and defend yourself!

  12. stand your ground. your property is your property, and as long as you are not breaking the law or posing a danger to others, you have the right to do whatever you want on it. if your neighbor is calling the cops on you for petty, idiotic things, don't take it. stand your ground, tell him that you're not going to take his c**p, and if he continues to threaten you, tell him to go **** himself. as for the police, explain that this has been a recurring issue and that you are well aware that you are not in violation of any laws. what you're doing on your property is YOUR business, not your neighbor's. make sure you let him know that. good luck with your problem.

The best thing you can do is record what happens at your parties and what happens when you interact with him.  Tell him you're recording him so that if he finds out he won't go postal on you.  Next, file a harassment suit if he keeps it up.  Just as he deserves peace and quiet, you deserve to live your life free of harassment...

  14. keep doing what you are doing evidently you have never been arrested or cited so you are okay pretty soon the police will get tired of the complainant and start telling them to quit calling.

  15. If you keep the noise under 80db at 50 feet, there should not be a problem.   Best rule of thumb...."If you can hear the noise over your property line.  Your too loud.

    Also try inviting your neighbors to the party.

  16. Although the noise ordinance in your city has time restrictions. Where I live if a noise is loud enough to be heard from inside a person's closed house, it is considered too loud and disturbing the peace. If you want to act like rowdy children, go to the park. Otherwise, it might benefit you greatly to respect the rights of others and obey the law.

Whats that old saying tall fences build good neighbors..put a buffer of ficas trees and a tall fence and then tell your neighbors to go f themselves if they dont like it...most "noise" ordinances...are from 10 pm until 7 am...if your making normal noise past 8 I dont think the police can even do anything...i hate neighbors like that..
