I have a payroll deduction for child support currently. A credit agency wants to garnish my payroll. can they?

can they garnish my payroll if I already have a garnishment taken every week from my payroll.

  1. In total a payroll garnishment can be 25% of your take home pay.

Yes.  They will be limited on the amount of the garnishment, but you can have multiple garnishments.  I'm in the same boat.  A credit card company is trying to garnish my paychecks & I pay support.  But the credit company has to get a court order first before they can start the garnishment, & we are in the middle of court hearings for them to try & accomplish that.  So look forward to some court dates & get an attorney.  I did & we've been in court for a year so far & the credit company has gotten nothing yet.  I've got another court date in August, so we'll see what happens then.

  3. The maximum for ALL wage garnishments at one time is 25%....If you are being garnished at this amount, the collection agency will have to wait in line until the current wage garnishment is completed.

  4. In most jurisdictions you can be garnisheed only up to a certain percentage of your gross income. They must,by law, leave you enough to live on. If I were you I would seek the help of a credit counselling agency. It looks like your in over your head and it's time for you to step up to the plate and get your affairs in order before you drown in debt.

  6. Child support is not the same as garnisheed for debt.  You are paying the expenses of your children.

    I have child rearing expenses, too.  But I still live with my children and am not billed for child support.  Do you really believe that you should be rewarded for not paying your child support voluntarily by being exempt from garnishment?

  7. Is the child support an actual garnishment or just automatically deducted from your check?  A lot of jurisdictions require everyone to have child support automatically deducted.

    Normally, the max that can be garnished is 25%.  Some states have a lower percentage.
