So here is the deal in 2005 i received a paraphrenalia charge in the college town that i went to. I moved back to where i live and received a dwi in the same year. When i was just about to get off probation for the first offense they ran my report and found out about the dwi, so i had a probation violation. I paid the fine and my lawyer and judge said that the case is closed......so i thought. My current employer ran a background which is standard, and the dwi did not show up on the background check but the paraphrenalia charge did, does anyone know why that is??????????????????????????

  1. Was this in NJ? A dwi will not go on your criminal record for a first time offender. In some states a dwi only goes on your driving history. Than again in some state a speeding ticket is a criminal offence.


  2. Talk to a lawyer, it is quite possible that you will be able to get it removed from your record. Good luck.

  3. In a nutshell, the paraphenalia charge is a criminal offense. You received probation for that charge. A sanction of probation is not to violate any law or commit any offenses or infractions. While on probation, you received a DWI, which constitutes a VOP by breaking a non criminal law. You paid the fine and that did indeed close the DWI case.

    On your background check, it will only show CRIMINAL infractions. Since a DWI ( at least with no specs) is not a criminal charge, it is normal for that not to be on the report.

    What you are showing is completely normal.

    PS...I am assuming the paraphenalia charge was a misdemeanor. Wait a year after being off paper and file papers in the Clerk of Courts office in the jurisdiction of the arrest/conviction and get that expunged. Then your background check will show nothing at all.
