I have a question about a possible medical law suit.

I had a baby Feb. 23, 2007. Since he was my 3rd, I opted to get my tubes tied after his birth. I had a horrible time w/ recovery. I was in a lot of pain. I assumed it was simply from the surgery since the only kind I had ever had was getting my tonsils out at that age of 13. Then after a while I got better. Then approximately 2 months later I had times off and on where I experienced stomach pain that was the most excruciating that I personally have ever had to endure. I would have rather given w/ no pain medication than feel this. So I finally found out that I had a hernia. I was told by my OB it was from my tubal . It has been fine up to now. Now I am going to the surgeon tomorrow. It has come back. I have missed a lot of work and have weight limits and such that are a pain. Do you think I could possibly be compensated for this? Or is it too late to do anything?

  1. From a Lawyer. You have 1 year from the time you found out about the injury. as for the law suit it all depends on if YOU can prove that your injury was caused only by the operation. If you can prove it was due to the surgery then yes you can sue for lost wages and pain and suffering. i reccommend you include pain and suffering. pain and suffering is when the plaintiff (that would be you) deals with an injury that causes you pain and suffering due to the negligence of the defendant.
