I have a question about age of consent...??

If a male from New York (a state where the age of consent is 17) has s*x with a female from New York who is 16 in a state where the age of consent is 16, is that legal? So if a male 24 years or younger has s*x with a 16 year old in a state where the age of consent is 16, is that legal or illegal (if they both are from NY)? Thanks

16 an 17 yes

24 and 16 no because the age gap is too large

The laws of the jurisdiction in which the act occurred apply, not the place of residence.  However, taking a minor across state lines in order to have s*x would be a much more serious charge.  Potentially kidnapping, which could result in a life sentence.

In New York, the scenario you're describing is a third degree class E felony under code 130.40, punishable by up to four years in state prison, and life-long registration as a s*x offender.
