I have a question about child support ?

I pay child support to new mexico and have a new case work who will not return any of my calls, i had arrears and have settle and paid in full in December 2007 the took my tax return and said they would give it back they have not yet sent it, now i have lost my job and still have no answers from my case worker i don't know who to contact about them (the case worker) doing their job because i have no job, but have been looking. This person will not return my calls, no matter how many numerous messages i have left that person. It's seems fine when they owe me money to keep and hold mine but if i'm late or do not pay i will get punished! Help any advice????

  1. I do not know the laws in New Mexico but if I was not getting any correspondence and help from your case worker, I would contact the office of the Attorney General in your State.

    That entity is most likely the party who manages the Child Support Division and can get you an answer in regards to your financial issue with your tax return.  


  2. you need to  call the  case mangers  boss or the  auditor for the agency .. if you still don't get a phone call then you need to  retain a lawyer.

    they should of never intercepted the  tax return if  you were paid to date ..  they do  turn cases in to  IRS every 3 months  on cases that have arrears so yours should of never been turned in to  IRS...

    it is possible that  they have already  released the  whole payment to  the ex and they are trying to fix the issue ( trying to collect from her ) and that is why they are not calling you back .they can not give you back money they don't have..

    when by bf of  13 yrs had over paid( which was their  mistake to start with. they took an extra  payment when we bought our house)  they did the same thing to him ( not returning his phone calls and avoided him when he went into the office to see her ) until they figured out what they were going to do about it.  it took child support   almost a year to  get back what he had over paid.. they had to  garnish her wages to get it back.. he finally got it in payments of  $12.50 a week .

  3. You need a lawyer, there should be a legal aid society in your state that has lawyers based on income, since you have none they may not charge anything.  Lawyers can get things done others can't.
