If a minor is drunk is that illegal, or do they need to possess it?

In case you are wondering, I am not a minor, but I work at a hospital and do legal blood alcohol testing. I had to do one tonight on a 14 year old, and I was just wondering what the charge would be?

  1. If you work at the hospital and your job includes legal blood alcohol testing -- shouldn't you be qualified, hence know the answer?

    I can not believe hospitals are hiring unqualified personnel's. This rises an issue if governmental jobs are supplying correct training.


  2. In my state it is illegal to be underage and drunk.  The fact they are drunk shows possession.  The person that supplied the 14 year old with alcohol should be charged with Contributing to the Delinquency of a Minor.  The 14 year old probably won't be charged due to his/her age.

    It is totally illegal for someone under twenty-one to have a bottle of alcohol in their possession, in their car, etc.

Minors are allowed to have alcohol in their system under one condition.  That would be when drinking at their own home with their parents.  Otherwise it is illegal for minors to have alcohol in their system.  The charge is "Underage Alcohol Violation" and has a bail of $100 and a minimum of four hours in jail.  The minimum time in jail is a law in my county as a "sobering up" period.

  4. It is legal if they were drinking in their own home, not driving, and didn't possess it in public.

    He would probably just be sent home to deal with his hang over and his parents talked to. Thats about it if he wasn't driving.

No, it is not legal for a minor to be intoxicated or have a bottle of alcohol on their person, in their vehicle, etc.  More than likely, the charge will be Minor in Possession of Alcohol.  The idea is that if it is in a person's blood, then they are possessing it.  However, I would like to add that, in most states, a blood draw is not needed for such a charge.  Rather, the odor of an alcoholic beverage is all that is necessary.  Perhaps, the individual was suspected of driving while intoxicated.  Yes, I know, if he/she is 14 then he/she should not be driving in the first place.  Hey, we have all seen stranger things.  I hope this helps.

  7. YES! is this a joke queastion. A minor being drunk is against the law and he will be fined and sometimes in extreeme cases the minor will not be able to get his license till the age of 18. If you are at a hospital just let the parents know. That way you dont have problems later on

    Minor possess/consume liquor in a public place is an offence under the liquor act. if over 16 can receive $225 ticket for each (possess and consume).

  10. unlawful consumption is the charge, and they will be asked where they got it. who ever supplied it can be charged with serving liquor to a minor.
