I have a question regarding US visa?

Hello. I am from Asia. I am married and have 2 sons. I hold a B1/B2 visa. I traveled to the US twice since 2003. I never wanted to live there illegally so I always had to return to my country. Now I would like to study in the US. Is it easy for me to get F1 visa do you think? Should my wife and sons apply for F2 visas the same time I apply for visa, or should they apply when I arrive in the US? Please tell me from your experiences.

This very much depends upon whether your wife is a US citizen.  If she is, she can petition for permanent immigrant status for you with only a few months lost.

I get the feeling that none of you was there legally, and that produces problems.   No consular officer could in good conscience grant you an F1 visa knowing you intend to stay.  Having a wife and children in the US, also in illegal status, will not help.

I don't know what your field of studies is, but if it is mathematical, you might find an employer willing to petitition for you as a necessary skilled employee, and an approved petition, including your family, would allow you to change your status, once arrived, to petitition for permanent-resident status, including your family.  That would give everyone a right to remain.

You might have to lie somewhat on your application.

Sorry to be so vague, but there are too many things I do not know.

I think you should go the U.S Homeland and Security website and email one of the reps there on the site.  Trust me, they will reply back via email.  Or if you want, you can call them personally.
