I have a tenant who wont pay rent, I have already given a 3 day eviction and she wont leave, what should I do?

I have no idea what to do except take her to court, but because of her my home is now in foreclosure. She and her family are destroying my only inheritance .

  3. If you've given her the three day notice to vacate the premises ; you need to get to the municipal court and file the legal eviction against her ....

    IF you can afford it ; I suggest going to an attorney and having them do this for you .... they have the connections to get it on the docket faster and get better results ....

  5. You need to call the sheriffs department to file an eviction so that they can remove here from the premises. You can't just call 911, local cops can't do anything for you with out the paperwork. Get started on this today. You will then have to file a motion against her separately to take her to court to obtain restitution/damages.

  7. The 3 day notice is only the tip of the eviction iceberg.

    It is a warning to either pay up or move out or an actual eviction action will be filed.

    Now you have to actually file the eviction action. If you have never done one before, call an attorney.

  8. I believe it is called an eviction but you need to take action and not let your tenant walk all over you. I would call the police and explain the situation.

  9. The eviction process  usually involves paying the county sheriff to physically serve notice at the tenants dwelling.

    Until he does that...there is no clock ticking.

    Go down to small claims court and find out all about it for free. For a simple eviction, you don't need a lawyer. It is a fairly standard  process.

    Remember....paying or not, your tenant has certain rights.

    Although, it sounds like your problems are allot more complex than just getting a tenant to move.
