I have a warrant, can I get a passport?

I applied for a passport last week, but I have a misdimener warrant in another state (that posted a few days after I applied for my passport) for not paying traffic tickets and missing a "must appear" court date.

Will that cause me to not get passport?

    (2)  Certain misdemeanors

    Subsection (a) of this section also applies with respect to an individual convicted of a Federal drug offense, or a State drug offense, if the offense is [1] misdemeanor, but only if the Secretary of State determines that subsection (a) of this section should apply with respect to that individual on account of that offense. This paragraph does not apply to an individual’s first conviction for a misdemeanor which involves only possession of a controlled substance.

    So no, you are ok.




  2. From the State Department website:

    "The principal law enforcement reasons for passport denial are a federal warrant of arrest, a federal or state criminal court order, a condition of parole or probation forbidding departure from the United States (or the jurisdiction of the court), or a request for extradition."

    A traffic warrant is not a federal warrant, and missing a court date is not a criminal court order.
