I have an iTouch and I get this one WiFi connection for free its called NETGEAR. Is this legal?

No password is required and I have no idea where it comes from but it atoumatically connects me, its not my fault it does that.

The Netgear connection is most likely coming from someone near you who is using a Netgear wireless router that they have not secured.  Your iTouch is seeking out all available connections and the unsecured connection comes up as available.  The legality of your use of this connection varies from place to place but generally speaking it is not a good idea to use another person's Internet connection without their permission.
