Question:

I have been caught shoplifting where i work at! What kind of sentence/penalties can I receive for 1st offense?

I understand that what I did was wrong! And I really don't need to be preached to about how wrong what I did was! Can someone PLEASE help me out by letting me know what I will probably face ... jail ... prison ... fine amounts ... community service ... probation ... PLEASE KEEP IN MIND THAT THIS IS MY FIRST OFFENSE AND THAT I HAVE NO RECORD OF ANY SORT!!! CAN I GET PRAYER FOR JUDGEMENT? WILL THERE BE A CHANCE THAT I CAN TALK THE JUDGE INTO DROPPING THE CHARGES? SOMEONE PLEASE HELP ME!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! THIS HAPPENED IN SHELBY, NORTH CAROLINA!

  1. Larceny by employee is a felony !  you will need an attorney for this charge. Being that it's your first offence your attorney may be able to get the charge reduced to a misdemeanor. The value of the product or products will also have some play in the charge. Hopefully  the value is under $ 1000.00 dollars because if it's over that two felonies can be charged. As far as you getting jail time or not, that will be up to the judge. Be sure to get an attorney that knows the law well so he/she can work with the charges.   Good Luck !


  2. First, you are panicking. Don't panic.

    You will obviously get fired for this. But if it is your first offence then you won't get any jail time. The prisons are so full that judges try to avoid custodial sentences where possible. My best guess would be that you will get a fine and probation. If it comes to court then you need to say to the judge that it was out of character and you need to show remorse.

    You will get a criminal record and it will be difficult for you to get another job anytime soon. This punishment is much worse than any of the likely sentences imposed by a judge.

    Better not make a habit out of it, in my state, 3 strikes and most people get handed 2 years in jail.......

  4. You will probably be asked to resign you position in exchange of the company filing charges. If they are really mad,. or the amount stolen was so great, they may pursue charges anyway and you will still get fired.

  6. The charges will not be dropped.  Many States have first offender programs if you record is spotless.  Basically, you stay out of trouble for a certain amount of time and do everything the court tells you to do, and possibly the conviction will be "removed."  

    If the theft involves a large amount of money and/or value, you are looking a a felony and possible custody time.  And stealing from an employer is somewhat aggravated as you are taking advantage of your position. This type of theft is called embezzlement.

  7. Stealing from your employer is stealing as a servant and is dealt with more seriously than a simple shop lifting. That being said if this was as you say a shop lifting matter you'll just lose your job and get a fine in court
