I have been on wc for a year working 1-2 hrs 4 day a weak for a herniated disk what is a fair amout settle for

insurance offerd me a settlement ask me how much i would want to close case and quit my job i have no clue what to ask for .

Well, considering that your working for 1-2 hours and the fact they want you to quit your job you'll have to think about some where in the lines of what is best for you.  Ask yourself, how long will it take you to find a new job considering your current disability?  Can you work for another job with your injury?  Will somebody even hire you?  Can you pay for medicals after you settle?  Does life time medicals included as well?  Are you a surgical candidate?  Are you a voc rehab eligible?

    Each case is different so you might want to counter with an offer of perhaps along the lines of $80,000.  If you ask for something like $1 million dollars than the adjuster will offer something down to earth like $25,000 to knock some sense.

    You could get a lawyer but remember they can take 10-30% of your settlement award.  I think $80,000 is reasonable to offer, hear their counter like if they offer $50,000 than ask for $70-75,000 than agree if you like what they counter or they will agree.

    Remember ask yourself those questions first before you offer.  You certainly are entitled to a lawyer to hear this out, it might increase your settlement but it might drag out longer than expected.  Lawyers are good, but sometime its the last thing you want to consider.  If you get say $75,000 you might come out as a win/win situation...but again, each case is different.

Back injuries are a problem because you have to think of how it may affect you in later years.  Your' doctor should have given his report which included a statement as to the problems you may face in future.  If he hasn't then ask him to prepare one.  Your' lawyer would be the best one to research prior cases and find out the average settlement.  Good luck.

If you did not have surgery, you should not get anything, most everyone over the age of 22 has herniated discs and you need to get off your bottom and get back to work.  You will NOT get enough on work comp to live on the rest of your life.  A settlement is probably a way for the insurance company to get rid of your claim.  Any settlement is to assist you to get back to work, even if you have to find a new vocation.  So don't think you will get some gigantic settlement cause you won't.  Any lawyer will take 10-33% of any settlement you receive.  So best answer is get back to work!!!

  5. you have to calculate how long you would be without income - forever? also, you would have to pay for own health insurance in the future, which will be expensive with an existing condition if you can even get the insurance, so you have to add medical costs into it also - if you were injured on the job (I'm assuming yes w/ WC), and you're permanently disabled - can no longer work even close to full time, you could be talking about a million dollars - don't know how old you are - the money has to last
