I have been threatened by someone that they are going to take legal action against me because they moved out ?

2 months ago and didn't take their stuff. Now they want it. I have been out of town. They are threatening me with legal action. Do they have any rights? Everything is in my name where we lived.

  1. Where is their stuff?  What did you do with it?

    In the US, if someone abandons property with you, you are an "involuntary bailee".  Generally, you have to give them notice to collect it and a reasonable time to do it.  If they don't do it after notice and a reasonable time, you may dispose of it.

    But if you sell it, you have to give them the $$.


  2. I used to work as a leasing agent in an apartment complex and whenever a tenant skipped out on us and didnt pay rent we threw everything out! of course the proper notices have to be sent out! but in your case idk you should consult a lawyer on that one!  

  3. You are back now. Give them their stuff. Since you didn't give them a date in the past that the property needed to be removed, it is still theirs.

  4. Yes, they have the right to their stuff.  Let them have their stuff.

    Edit: If you got rid of it, next time have a lawyer draw up a letter and have it sent to them stating they have X amount of days to get their stuff or it becomes yours to do with as you wish, as of such and such a date.
