I have reported the selling of drugs several time to the police. I feel like I am up against the wall because they keep coming but when they leave they start right back up. The unit I stay in has just been sold to a new landlord and I would like to amend my lease so that I may just leave a bad situation. I have looked over my lease and it violates 2 ordinances within my lease. I meet with her friday , I have several witness including the previous owner of what goes on here. What do u think I should do. Should I use that as my way out or the existing health problems as my reasoning for wanting or needing to move back in with my parents before my health situation gets ireverisble.

  1. Well ; you could use BOTH issues to get out of your apartment .....  since it is so bad .....

If you have contacted the police, they came out, but made no arrests, then you have no proof.  Your "witnesses" have no concrete proof either.  The police must have solid proof of the crime in order to arrest.  The landlord must have solid proof to evict them, not just accusations.  Just as you have to have solid proof to prove your "health" situation is real and as a result of the problem. Unfortunately there have been too many false accusations and arrests without proof, that the police are real careful on how they arrest people.

    As for amending your lease, that cannot happen until the existing lease is up. And if you are wanting to move in with yor parents, why would you amend the lease anyway?

  3. Perhaps the police are doing an undercover investigation now that you have reported the incident. How can you prove to your landlordd that is in fact what is going on.  You need concrete evidence not hearsay.  I am not doubting you, I just know they could say prove it.

  4. Take pictures and save the police reports then tell her that it is not a safe place, and also document the problems with the apartment and violations of the lease, tell her that it is time to move.

  5. Use what is violating the 2 ordinances in your lease! If you want or need to end your lease you'll get a too bad so sad from your landlord and get fined. If you have solid proof that 2 ordinances are being broken run with it. I'm not sure where you live but most communities have free advice services for you to use. Try calling your local town or city hall for help. Good luck and feel better.

  6. Don't just call the police go down and sit with an officer ask advise of what you should do and file a formal complaint. You must be willing to possibly identify them for arrest. And if you go to your local HUD office they have renters advocacy attnys for you. I also would not go to that meeting with out an advocacy attny at my side.

  7. Get a video camera to document the activity. Meet with the new landlord and demand that they take care of the problem or allow you out of the lease.

  8. Here is your problem:

    No arrests, no convictions.

    My neighbor has people going into her house all the time.  They stay about 30 minutes, and they leave.

    She is a licensed hair dresser and works out of her home.

    Unless you can tell the police you have SEEN money exchanged for drugs, they cannot do anything.  People going in and out of an apartment, is legal.

    You have no grounds to break your lease.

    There is nothing wrong with your health than a dose of reality won't fix.

    The landlord DOES NOT have the legal authority to evict on SUSPECTED drug use/sale.  They can turn around and sue her for an illegal eviction.

    Unless someone has been arrested AND convicted there is NO CRIME.
