I have filed bankruptcy on payday loans can they still put me in jail

my payday loan was got on the internet dont know the name of the company but i put some under bankruptcy they call my job talking about putting me in jail but they wont give me the company name

  1. There are no debtor's prisons so they can't put you in jail for owing a debt.  However, if you wrote a check to be cashed on your payday, you still have to make good on the check.  If it bounces, they will send it to the DA's office and give you so many days to pay it and after that, can get a warrant.  However, the calling you at your job is really something else.  They want you to pay it but if you get fired, you really can't.  I'm not sure what the law is regarding calling you at work.  I took a pre-law class on debtor/creditor law and the teacher said that collection agencies aren't supposed to call you at work after you tell them not to.  But this isn't exactly a collection agency so I'm not sure.

  3. If you have filed bankruptcy, they are not allowed to contact you.  Should they call and try to harass them, give them your attorney's name and tell them to call them, and to leave you alone.  I think by law they are not allowed to call you any more.

  4. No they can't. Hold it where are you? Because I never heard of going to jail for a defaulting on a lone.That is alot of bull. Tell them you filed bankruptcy on them. Next time anyone calls you at work have the person who answers the phone to take a masage. If your the one answering the phone go off on them, ask to speck to their superviser.Tell them your going to see them in court if they keep calling you on your job. Or do what I did for a friend. I told them something was wrong with this call because she had won the lotto and moved to Bahamas. Hope this helped

  5. Sometimes you have to back track...you don't have the old check where you first wrote to the payday company. ? Maybe you can go to you bank and get a copy of the old check and it will say where you wrote it to and you can start from there. *** You have to be careful of payday loans...they can get you into nothing but trouble. *** Good Luck  

  6. Nope can't put you in jail for a payday loan. They can threaten all they want but, it will never happen. If they didnt meet you in bankruptcy court then they can't do a darn thing now.

  7. You usually can't go to jail for default loans. If you have actually filed bankruptcy all harassment must cease as well as any atteempts at bill collecting from the parties you named. If it is them, and you can prove it, you can win a civil case against them.

  8. We don't have poor houses anymore so they cannot put you in jail.  If you have filed for bankruptcy tell your attorney one of your creditors is harassing you at work. They are not allowed to do this and he will inform them of this.  If they call again ask for the name of the company and ask to speak to the person's supervisor.  Inform them that you are in bankruptcy and are aware that they are not allowed to contact you or threaten you.  Be polite but firm.  Be sure to say the words "do not call my place of employment ever again.  They have to give you the company name they cannot just call and issue threats.

  9. The only people that can put you in jail for not paying a bill is the IRS, for tax evasion. The next time they call you tell them you have filed bankruptcy and give them the name and number of your bankruptcy attorney.

    After that , calling you or harassing is illegal, for them.


  10. They are breaking the law themselves. They are not allowed to contact you at your place of work or your employer to harrass you. Contact your attorney and have a nice fun time with them.
