I have had cps cases in the past where they have put my children up for adoption and terminated my rights. ?

I am currently 9 months pregnant and will deliver in 4 weeks. I have been off drugs for almost a year and a half, i have a house, a car, and a job in waiting my husband has also been clean for the same time and has been on his job over a year. What I want to know is can cps legal;ly takke custody of my child when he is born?

  1. They must have probable cause.  However, their idea of probable cause may be different from ours (eg. if you had a past record of neglect/abuse, it could, in their eyes, be cause to take the child under an order of protection until you prove to the Court that you are fit.)  In any case, with your recent history, you should be able to prove that quite easily, so it would mean that your child would be in their custody only for a short time.

    I've been watching this raid in Texas of the FLDS children by CPS.  These groups are supportive of people in your situation.

  4. By federal law (ASFA), they can take the child. But in many cases they will simply keep a watch on you to see if any sign of drug abuse shows up.

    When you go to the hospital to have your baby, bring with you the evidence that you have had treatment, rehab, and any evidence (letters, etc.) that show evidence that you have stayed off of drugs. Also bring the evidence on your husband. Hopefully the social worker will decide to let you take your baby home but visit you at home occasionally to see how things are going.

    If they do end up taking the baby, don't despair. They will probably return it to you after a few vists when they see that you are really off drugs and have your act together.
