S they can, u need to first give a complaint to near by police station and get the FIR report, then u need to proceed with the formalities for applying the new pan card.

yes someone can misuse it,   for precaution intimate police where it has been lost. make two copy of intimation letter and one take  as receiving form such police sation where u want to intimate, keep the receiving copy for record and apply for new pan card
