Question:

I have missed the oppurtunity to appeal against a final hearing. Can i start legal proceedings again.?

My daughter does not want to live with her dad and everyone knows this. Her dad told the court he would not see her if she lived in cornwall with me as she did for 8.5 yrs she is now 9.5yrs. He is unemployed and receives disabillty and constantly complains of no money. I have to go back to work once my maternity allowance finshes as we cannnot pay the mortgage. I will then not beable to see my daughter as everyone knows how hard it is to get time of work for the school holidays! I have been given 7 weeks. Her dad does not work and could have seen his child 52 weeks of the yr. He also sai he neer wanted to see her. Many people have said he only wants her for the extra benefit. He was a money grabber and still owes me over £1000 from 8 yrs ago. Also we still have not had the judgement.

  1. You haven't had any answers so far because we can't understand the scenario you're presenting.  What hearing?  You said there hasn't been a judgment yet: What do you expect the judge to rule?  Why?  How do you expect to appeal a ruling that hasn't been made?

    Hmmm ... please ask someone to help you rephrase your question. Sorry I couldn't help at this time.


  2. If you have not had the judgement, you have nothing to Appeal.

    You can't start legal proceedings again to determine the same issue.  But you may not need to.  Wait for the final decision.
