I have outstayed my waiver visa for 3 weeks in 2003 and want to back to states in feb can i get waiver visa?

  1. No once you have overstayed a visa waiver term you cannot enter on it again. You can however apply for a visitors visa at the Embassy. Explain on the application the circumstances of your overstay. Chances are good that if all else is fine with your application you will be granted the visa.


  2. It's very unlikely. You can get on the plane and fly to the US, but chances are very high that immigration on the airport won't allow you to enter without a regular visa, and will simply put you on the next plane back home. They could use their judgement and let you in, but it's  not something you can count on. You'd be much better off applying for a visa and then coming in.

    Even if you left voluntarily in 2003 there will be a record of your overstay.

    Failing to disclose this time around will mean automatic deportation. Disclosing it results in refusal of admission so no chance using the waiver system.

    Best you can do is contact the nearest US Embassy and plead your case.

  4. They might let you in, but my bet is that you'll be detained and placed on the next flight back home.  There's been a whole lot of stories here in the press about people from Europe with previous overstays being sent home.  They're taking it very serious.

    I recommend you get a visa.

  5. You are no longer eligible to use the VWP due to a previous violation of the program. You are permanently barred from admission under the program.

    Unless you want to gamble on being admitted erroneously, you would be wise to apply for a visitor visa.
