I have recently been over paid at work, can they demand it all back?

I have recently been overpaid, two months on the run at work. I noticed this month and went to tell them, which is where the found out that they also did it last month. I am leaving in about 5 weeks, and they have said that i have to pay it all back before i leave. However i have just bought a flat and cant afford to give it back. We have comprimised and have agreed for me to pay over half of it back before i leave, however it will still be hard to do that. Where do i stand legally, can they demand it all back or can i set up a monthly payment plan even though i am leaving? Please help!

  1. You need legal advice. Don't sign anything until you receive advice from an attorney familiar with the employment laws in your area.  


  2. Yes they can demand it back. You did not earn that money.

    There is no rule that says when an employer (or bank) makes an error it your favor you get to keep the money. There is no version of "finders keepers -- losers weepers" in the adult financial world.

    If you do not pay it back - they can and will sue you.

    You did the right thing by pointing out the error. They would have eventually found it any way and then you would owe them more than you do.
