Question:

I have split from the mother of my son (unmarried) and am applying for a res. order. Am i wasting my time.?

I am currently in another secure relationship and am expecting another baby in 3 weeks. I have no objections with the way that my son is being treated by his mother, however, I do have him approx 80% of the time and care for him. His mother has a job involving lots of worldwide travel and feel that it would be beneficial if my son was registered as residing at my house for schooling. medical etc.. I would not deny contact from the mother. I just feel that it would be in the favour of my son if he was resident at my house. Please provide feedback.

  1. ok but what is the restraining order for? or did you mean residence order? look, u two have to come to an agreement, and if you guys dont see eye to eye but i highly recommend you guys do, then go to court and have the judge. remeber dont look at your convenience and benefit, look at your childs...good luck


  2. If by res. order, you mean a restrainging order, dont get one,

    but if you mean you are trying to get it so your son is living with you, not with his mother, yes try.

    But first, (if he is old enough), talk it over with him to check he is OK with it, and also with his mother, explain to her how you feel, and try to come to an amicable deal

    Also if it goes to court, you will need to state to court what you have said here, and be able to prove the mother does travel alot, if oyu cannot prove this, don't bother trying

    Getting an amicable deal with the mother will also help alot as it will save you alot of trouble if she challenges it

  3. no need for a restraining order...

    if u do, u will contradict wat u just sed.

    she wont be able to see ur son.

    so, just make him live with u. she can come visit.

  4. What do you have against marriage and a serious commitment?  As long as you continue to choose to be making babies with anyone and everyone, you will continue to have these types of problems.

  5. res order no the courts see that as you dont get along but what you need to do is go to the court and get custody papers that state she has given you full rights to your son if there is no abuse going on on either part then you should have nothing to worry about just go get the papers and if she agrees then everything will go smooth GOOD LUCK
