I hit pothole on my motorbike council wont pay. my bike broken?

  1. contact a solisitor first..take as many pics as possable..especialy of the pot hole....cos the second you contact the council they will fill the hole and call you a lier...


  2. you need a witness and photo proof at the time would help . a bust bike and ripped clothes could happen anytime

  4. this question is confusing but if nothing happened to your bike except some scratches and stuff you just need to keep your cuts clean and get some clothes..

    ride safe...

  5. Without independant witnesses' you do not have a leg to stand on (no pun intended). The damage could have been done anywhere. This is bolting the stable door after the horse is already halfway down the road, but if ANYTHING like this happens again, try to get the name and address of any witnesses' to the event, without a witness no one would admit liability.  This happened to me in London 20 odd years ago when i hit a really deep pothole late at night in heavy rain and it almost ripped the nearside suspension out of the car.  The council refused to pay but said that they were aware of the pothole in question and they had placed 2 warning lights by it - well, if they did, some nice soul had pinched them before i came along. No witness and no compensation.

  6. Collect evidence, photos, receipts etc and tell them you will be going to small claims court if they wont resolve the matter and see what they say. If you have to take them to court at least you will get some recompense. Its not that expense and straight forward.

  7. They should be able to pay, though they wont under the following circumstances:

    The roads service will do checks every now and again of roads to check condition, if they have indentified the pothole which caused you the damage within a time frame of 3months then they are not liable to compensation.  Though outside the 3months time frame if the pothole has been indentified then they are liable for it.  

    Just keep a record or the date which it happened, so take photographs of the pothole and your bike and your self, it would probably help things if you went into hospital on the day it happened...
