    Will gets into a minor accident and doesnt have insurance so he gets his uncle ( a lawyer) to defend him, Will wins because his lawyer gave a d**n good reason

    i have been in 3 and non my fault

    LUCKLY THANK GOD the other person has had insurence

    if they didnt have insurance u would be screwed

    so if it wasent your fault and the other guy doesnt have insurance then i am not sure what you are really worried about. If its more transport just go and higher a car, if your car wont be ready for alomst another week or so on and if your car isnt fixable i am sure thats what your worried about but god to hope that its not

Call his insurance company and file a claim.  They will take a statement from you and make arrangements to see your car.  They will need to take a statement from their driver, as well, before they agree to pay for your damages.  If there are witnesses or a police report, make sure you give that information to the insurance company.

  4. They will still be around as you did not have insurance ( notice how it is spelled). If you do not from his company call them. You will receive a fine for no insurance.

File a claim with the other driver's insurance company.  If after about a week things aren't progressing (they're not contacting you, etc) then file a claim with your own company and let them get reimbursed from the other driver's company.  This process is subrogation.  In subrogation you'd have to pay your deductible initally to get your car fixed, but then it will be repaid back to you based on the amount your company was able to recover.  If they recover 100% from the other driver's company you get 100% of your deductible back, if they recover 80% then you get 80% of your deductible, etc.  Rest assured that if the accident was truly 100% the other driver's fault your company will fight for 100% reimbursement, they don't want to pay any more than their fair share of the claim.  If you don't have collision coverage on your car then your company can't help you because you didn't purchase collision coverage and the "help" (subrogation) that goes along with it.  In that case you'd just have to go to the other driver's insurance company yourself.
