Hi again, I found a mistake on my nephew's plea agreement. The sentencing is written twice for one charge and they omitted the other one. Can this be used as a loophole. I called a lawyer today about my previous ? and he basically told me he was stuck. No one wants to deal with bad cops!! I know I am grasping at straws but He really is a good guy and I wish he hadn't made this awful choice. Thanks, Lori

  1. NO. A clerical error is all you have. The sentence and conviction are part of the court record. Instead of trying so hard to get him off, how about trying to teach him that his behavior is wrong?


  2. By all means help him avoid his responsibility and get away with being a criminal. That will serve him well in the long run.

    Rarely would a typo or administrative error be allowed to affect a legal action.  And of course it is all the cops fault for your nephew's troubles.

  3. No, this is not a loophole.  It would probably be considered a typographical error by the clerk, and is not subject to use as anything to abate the sentence.
