I just got a letter in the mail for jury duty and I am not a US citizen!!! i am here legally with a work visa.

Would they make me go anyways?

I wouldn't like to go because I planned to go to FL for a long weekend the day after this jury... i need to know what's going to happen so i cancel my ticket or not.

does anybody know if i would have to go even if i am not a citizen?

  1. If you have a drivers license that is probably where you name and address was picked up. Just call the phone number on th summons and tell them you are not a citizen, and they will take your name off the docket


  2. Somehow you got registered to vote because that is where jury lists come from. You are in deep trouble for registering to vote and not a citizen. Thats a felony!

  3. Good news and bad news.

    1) If you are not a citizen you CAN NOT serve on a jury. Best case is you call the number on the summons and tell them "Hey I got this jury duty notice, but I'm not a citizen." and they should be able to take you off the roll.  It shouldn't be a problem. Worst case is you have to go down to the courthouse and sit in the jury assembly room for an hour. AT some point the clerk will come in and give a little speech about who can and can't serve on a jury and say "IF you can't serve on a jury for any reason, come forward now" and then you go up and say "I'm not a citizen, here is a copy of my work visa" . They will look at it and say "Oh, you are excused" and you can go off to Florida.

    Bad news is...Most jurisdictions (not all, some pull from drivers liscense rolls) pull the people for Jury duty from the VOTER ROLLS.  This means there is a very good chance that you are registered to vote. That is SERIOUS because non-citizens are NOT allowed to vote in U.S. elections. If you have voted you can get (I could be wrong on this) between 5 to 7 years in jail, and then deported. Just being registered is probably a violation of your status with immigration, and that is DEFINITELY enough to get you deported ASAP.

    You probably got registered to vote under the Motor Voter scheme the Democrats pushed through a few years back, where people register to vote when they get their drivers liscense. I know immigrants who wound up accidentally registering to vote because they were filling out paperwork and just filled out one form to many.   In any case you need to get your name OFF those voter rolls ASAP before the ICE comes and checks...(you think the ICE isn't going to be checking that in an election year?).  Call your county clerks office (they handle voter registration) and check if you are registered to vote. If you aren't no problem. If you are get unregistered ASAP.

  4. There is a number on the summons.  Call and they will take your name off the list.
