I just got a new roommate. She gave me 2 checks for the deposit and 1st months rent and it was returned!!?

My new roommate gave me 2 checks that total 1600.00 I deposit the security deposit in a money market so that it can accrue interest. And I deposit the rent into my checking account. I then got a call from both banks and they told me that the checks were returned because the account was closed!!.

I would understand if there was insifficient funds and it was returned, but she gave me checks on a closed account!! What should I do! I am stranded now...does she know that her account was closed

  1. You signed a lease agreement with this girl?

    Phone a lawyer first, just to make sure, but given that she's committed fraud,and hasn't payed you or honored her half of the egreement,    you dont have to honor the lease and can throw her out immediately.

    Really.

    Don't keep a criminal in your home.

    Put her out today.

    And dont pay for the lawyer (an initial consulatation, or a quick question on the phone is free).

    Oh and if he does try to say you have to let her stay without paying, thank him, and then throw her out anyway...if she threatens to complain about this, file charges against her for passing bad checks (its actually a crime, you could have her arrested).


  2. Definately talk to your roomate. Ask her if she knows what happened with the account. Maybe also go to the place where the account was taken out and see if there is anything you can do. I don't really know much about the situation, but I would think she would know if the account was closed or not. She would have to close it right?

    Well in any case you need to find out what you can do in this situation, like what you are responsible for legally and what she is responsible for. The last thing you want is to be out the rent money she was supposed to pay. Hopefully it was just a misunderstanding and you can work it out.

  3. Banks do not close accounts unless there is zero balance and no activity on the account or she had the account closed.

    Either way, if the account was closed, she would have known that the account was closed or that there was no money in the account and by willfully writing bad checks she committed felony fraud.

    Press charges.
