I just got fired,....do I still get paid vacation time.

I work at a group home and I am to dress the girls every morning before I drop them off at day program... yestereday, I mistakenly put one of the guy resident's pants on the girl resident. I was given a write up and was advised that if it happened again I would be fired. But today in the morning I got a phone call from my boss, she left me a voicemail saying I was terminated from there, and days before my vacation, ( I was owed 64 hours vacation paid) which I would be taken on friday. now my ex-boss says I won't get paid for vacation time... is this legal, is there anything I can do?

  1. They'll most likely include it in your last check.    


  2. File for unemployment.  If you accumulated paid vacation time, they have to pay that too.

  3. You are supposed to be paid vacation time, its time you earned.

    Vacation time (annual leave, sick leave, etc) are FRINGE BENEFITS, and if you're not entitled to them...it's up to the employer to pay the time, but legally, they don't have to pay it.

    You can look this up on the US labor dept's website.

  5. It depends on the company policy.  Some companies have policies that say they do not have to pay your accumulated vacation if you are terminated.  Check your company policies.
