I just got fired from my cashier job for being pregnant?

today was my second day on the job and im pregnant. i told my boss im pregnant and cant lift very heavy things you know? and she told me that i cant work there any longer bc i cant preform the duties as a cashier, and i told her yes i can? i worked yesterday 9-3 and it went fine, why not? and she told me that people will buy heavy water bottles and stuff, so i left. so yea basically, i am jobless now. =\

  1. You did not get fired because you were pregnant.  You were fired because you told your boss that you cannot perform your job duties due to your pregnancy...and part of that job includes heavy lifting...there is a HUGE difference between these two.  You admitted to her that you could not do the job, period.  She is within the legalities of unemployment and dept. of labor in firing you.


  2. you need to lead a less drama free life. EVERY SINGLE DAY you post something on here. my ex this, his girlfriend that, im going to say this to my boss etc etc.

    i felt sorry for you as you seemed to have an awful lot of bad luck, but 90% of it just sounds fabricated now.

  4. Yeah I'm pretty sure it's against the law to fire somebody because they are pregnant.  Don't let her get away with this!

  5. They can't fire you for being pregnant, but they can fire you for not preforming your job. You should have known that working at a grocery store entails lifting when you applied for the job. I am sure that it says it on the application form- even cashiers have to be able to lift here. If you checked yes next to the question: "are you able to do some lifting", then they had every right to fire you.  Why should they hire you when you can't do the job that you're being paid for?

    Plus, it sounds like they didn't fire you, but you left.

    I am very sorry for you and for your situation, but you don't have a case. Try applying for a clerical job.

  7. the store would be liable if you hurt yourself, and you would sue. They have to protect you and themselves

    They can only sack you if they have looked at safe ways you can perform your job and don't find any. That is depending on your contract - if you don't have one or you're on a probationary period, theres nothing you can do.

I think that it is illegal to fire someone because they are pregnant.  You could probably lift the bottles, b/c a 24 pack of water or beer or whatever isn't that heavy, until later in your pregnancy when your doctor tells you not to do heavy lifting.  Like I would not go lifting 100 lbs right now, but a few pounds I think you could do, and many people leave them in the cart and you could probably even tell the customer they can leave the one heavy object on the cart and you'll scan it from there (makes it look like you are helping them).  I think that you were wrongly fired. Your boss was probably mad b/c she unknowingly hired a pregnant woman and if you told her before she wouldn't have hired you for that, which is also illegal, women are often not hired because they are pregnant or married (think you'll choose the kids over them, so just take your ring off b/c they can't ask you that), so you may want to call your lawyer on this one.  Good luck on this one, you deserve your job back.

  10. You had been there one day and told your boss you are unable to preform your job. You can be fired for any reason (or no reason) within the first 90 days. You also said "So I left" which implies you chose to leave. Get a new job that doesn't involve heavy lifting.

You were an at-will worker and you were a probationary worker.  You didn't have a contract.  They can fire you for any reason or no reason at all.  They didn't fire you because you were pregnant.  They fired you because you couldn't do the job you were hired to do.  It was your second day--they don't have to find a way to make you able to stay.

    Get a job that doesn't require heavy lifting.  Make sure you understand what is required before you take a job.
