Question:

I just got in an accident that was my fault but the driver was drunk and took off. What can happen?

i made a complete stop at a stop sign but there were cars parked near the corner so i couldn't see the truck or how fast it was going. i inched forward and believed that i had enough time but the car was going too fast and hit me. the driver then took off and witnesses say he appeared drunk. what can happen in this situation???

  1. Report this to the insurance company as well as getting a police report and state what you saw, since the other driver left the seen the will be a hit and run and he will be responsible for everything......................


  2. they will automatically make this his fault since he took off and left the scene of the accident,even though you pulled out in front of him he was supposed to stop so he may have something to hide,this one you may come out ok on ,but they may still rule it as being both your faults,but he will be in more trouble than you are right now,he shouldn't have left the accident scene,good luck on this one.

  3. Tell your insurance he was drunk, supply witnesses and there testimony and laugh. It was your fault until he took off.......

  4. I'm going to go off on a completely different tack here and say that you are very lucky, and you should simply walk away. You would have a hard time proving he was drunk, because if he was he's sobered up now, and as a result you will also have a hard time proving he was at fault, because you pulled out in front of him. Unless anyone got his license plate number or knows exactly who he is, it's game over.

  5. What the insurance people don't know cant hurt them. For all they know, you were following regular traffic laws. Get those witnesses testimonials saying the person appeared drunk and plus he/she? took off. Work towards your own advantage.

  6. Appearing drunk and being drunk are two completely different things. Can you prove beyond any doubt that the driver of the other vehicle was drunk?

    You can likely be charged with "failure to yield"...not exactly a major offense. The other driver, however...if found, that is...can be charged with leaving the scene of an accident, which is a serious offense.

    Of course, by then, it will be far too late to test for alcohol intoxication.

    Were the police involved? Is there a report? Did any of the witnesses get a description and/or even a partial license plate number? If so, then you might have something to go on. Good luck.

  7. Hopefully you'd have a plate number to give to the police. If not, this would come out of your insurance, or your pocket if your not covered for this type of thing.
