Question:

I just went to Cabellas to purchase a .243 Buckmaster, and they told me I have to wait four days. ?

I kind of expected this because I have a couple misdemeanors, namely 3 minor in possesions, 1, possesion of marijuana, a assault & battery (not a domestic) and a possesion of paraphanalia, (papers). I know it's a long list but the majority happened as a minor, im 24 now. Will the feds give me a hard time?

  1. You were delayed, which means the feds can take up to three days to research your background.  During that time, they can proceed you or deny you.

    If you do not hear anything from Cabella's, the Brady Law kicks in and after three full work days, you can pick up your gun.

    If you get a call and are told you were denied, you will have to get legal help to try to clear up you record in order to ever purchase a gun.

    That's the law and nothing you can do but with legal help try to get things cleared up.

    I would say with an assault & battery you are going to have a very hard time!

    I work at a different large retail sporting goods store in Mich and have dealt with people that have run into similar situations.  And they've told me there is alot of time and work and patience involved in getting things cleared up.

  2. Humm, did they actually say that it was due to your background check? I've got numerous issues with my record from my teens and I've never had to wait more than 30 minutes for the check to come back. Considering that what you describe are not felony charges that wouldnt set off any flags.  

  3. In CA we have a mandatory waiting period after purchase... it's 10 days for any firearm.

    Our waiting period is our nanny state trying to "prevent impulse buying" of firearms; so your record has nothing to do with it here.

    The state law page for MI at NRAILA.ORG, listed below, doesn't say anything about a waiting period, but it does say it is subject to change.  Maybe there's some waiting period that's been added since?

    Other than that, I really don't have a clue.

  5. i live in mi also.  your nics drew a red flag, you have been  "delayed"

    for up to 4 days. they will call you  with a  ya or na. this will happen every time you do a nics, they have to check you out. the system works.  most likely  it will be yes, but it can take awhile to do a complete check on you.  i had a security clearance when in the army, i got delayed every time for about 10yrs after it expired.  so expect to wait , my longest was 2 days.

    OH...sorry..I live in a state that has "instant" background checks.  My bad.

  7. yea... and if you have a felony you are slammed. Was that A&B a felony in your state?

    You may want to have a lawyer file a motion to "expunge" your record. People read the rules and dont realise that stuff follows you around sometimes ...even if it was implied to you that it would not

  8. was it because of your record, or did they have to order it?  Also what state are you in, some states background checks are instant while others take a few days.  If you have no felonies or domestic charges there is nothing that can stop you from owning a firearm
