I just won parental rights with my daughter, now my fiance wants to adopt her, help!?

My ex has lost all rights, and I want to have my daughters name changed but my fiance also is interested in adopting her once we marry next year. We don't know how to go about either and I know my ex wont go for either choice. how do we go about this?

  1. If your ex has lost all rights then he doesn't have a say so in what you and your fiance decide. If your ex is part of your daughters life and is there for her even though he lost all rights, then I would tell your fiance that it's not a good idea.


  2. If he has lost all rights than he has no say in the matter. To change the last name just go to court and its usually like 65 bucks and they will change it for her. To adopt ask while you are there you most likely will have to use a lawyer.

  6. If you ex lost ALL parental rights then he has no say so, but it has to be ALL rights.  All you two need to do is go to your local courthouse and let them know what you are trying to do and they will let you know the appropriate steps to take.

  7. Well, first of all, your fiance can't adopt until you are actually married.  Have you talked to your lawyer that you hired?  S/he can give you all the info you need.

  8. If he lost all rights, he no longer has control over the situation except what you give him. On the other hand, it's no business of your fiance what you decide to do until you are married. He did not help bring her into the world and has no more parental rights than your ex at this time. Marry the guy first and go on from there. He can't adopt her with you from out of wedlock.   9. I think you are misinformed on the wording. You did not win parental rights (you already had them...every parent does) You must have won full custody.  But he still has rights. And getting full custody is very hard to do these days. Do you have full custody or just joint custody with placement with you.? You do need his permission to change childs name and to have fiancee adopt.

    My husband and I are in the process of getting my 2 children adopted. They will be adopted by this time next month.

  11. For legal name changes, you must petition the court where you received your divorce, which is the court of jurisdiction.

    For the adoption, you need to get an adoption attorney to get copies of your ex's termination, then proceed with an adoption.  It can be expensive, sometimes $2000-$3000.  But you will need to wait until you are married.  And it is advised to wait for another year or two after that.  The name change, and your fiances involvement is the most important to her right now!

  12. If he was completely stripped of his parental rights than your fiancee can adopt her. Unless it was a temporary stripping in which when he improves whatever he lost them for he can apply to get them back. But if he was told that he no longer has rights to the child and he is not allowed to see her, is under no obligation to pay child support than you can let her be adopted. If he is still allowed to do these things then he still has some rights. Be cautious, having soul custody does not mean he has no rights it actually has to be stated he has lost his rights. And to have her adopted /name change you just have to petition the courts. Most courts have the documents online for your state for free. And most courts will make you pay for the documents if you go in and request them.  Also if you find that he still has some rights to the child you can ask him to sign his rights over so that someone can adopt her. But other than that you can't force him to give up his rights unless the court stripped them.

  14. I think the only way he can adopt her is if your ex gives up his rights as a father I forget the exact name, but papers have to be signed. You can look at the custodial rights for your state or call they we give you exactly what you want to do.
