I know I am going to fired tomorrow. What are my legal rights ?

I know I am going to get laid off tomorrow because of lack of work. I am afraid I will get docked pay because of a verbal agreement I had with the owner during school and the hours I missed because of it. I got paid salary. What is my legal rights? Can they dock my pay?

  1. Yes, they can.  A person should only get paid for when they work. Why did you miss so much work?

    Edit: Ok, you are getting laid off.  That's different from being fired.  And verbal agreements mean nothing in a court of law.  No legal anything there.  Go to the unemployment office and file unemployment.


  2. sorry to say but of you are a casual your rights are very limited (i'm talking slim to nil). You have the right to claim unpaid wages.

    If you are part time then you have a few more rights - same as above and a few more things

    Full time you are entitles to an ETP (i think that's what it is) pay and all your leave to be paid out.

    if you are paid off the books you have noting as you legally didn't work there. You can contact dept of fair trading and they can help you. don't go there if you were paid off the books as that is a tax violation.

  3. lay off due to lack of work gives you rights to unemployment. every state is different. contact your local department of labor
