But how do you prove it when they didn't inform you that they were recording. I would have had to record his recording me and inform him that I was recording him. Is there some thing you can buy to add to the phone to detect this???

  1. There are many ways to record telephone conversations.  Some of them are undetectable.  For example, iIf someone has a 'suction mounted microphone' on their telephone handset, you won't be aware that they are recording because there is no actual electronic involvement.  The microphone is no more invasive than an ear to the phone.  Where I live in Texas if you are a party to a conversation you can record that conversation without notifying the other party.  It is perfectly legal.

Found this in about two seconds on the WORLD WIDE WEB, pretty easy to source this stuff!:

    Legality Of Phone Call Recording

Telephone call recorder systems are useful in recording and documenting calls, whether they are received or made. Recording phone calls is a useful tool, especially when recording issues of vital importance. From CEOs, to call center employees, to the general public, the ability to record calls comes in handy for nearly everyone. Most importantly, recorded telephone calls are a concrete, irrefutable record of a conversation, which can be used in legal matters. This brings us to the legal issues involved in telephone call recording. Recording a call is perfectly fine if there is consent for the recording. Currently, consent consists of two possible types:

This brings us to the legal issues involved in phone call recording. Recording a call is fine if there is consent for the recording. Currently, legal consent consists of two possible types:

    One party consent

    All party consent

    One-Party Consent

One-party consent means that at least one person is aware of the phone recording. The laws and regulations on phone call recording differ by federal and state governments. These regulations are based on wiretapping and eavesdropping legislation. Only one party consent is required in thirty-seven states and the District of Columbia; this means that you are allowed to record conversations which you are party to without informing the other party. Additionally, regardless of the state, it is not legal to record a call to which you are not a party, or a call that you do not have permission to record. It is not legal to disclose the content of an illegally recorded conversation, except where litigation is concerned.

    All-Party Consent

All-party consent involves notification that the phone call is being recorded. This may be verbal notification or in the form of an intermittent beep that both parties on the line can hear. Twelve states in the United States require all party consent, whereas most states have only one-party consent. If the telephone call recording is on an interstate level, make sure you follow the regulations of both states.

    International Telephone Call Recording

In the United Kingdom, individuals can record their phone calls for their own use. It is prohibited to provide the recorded information to a third party. At the international level, phone call recording regulations vary from one country to another. In many less-developed countries no clear laws exist pertaining to telephone call recorders.

    Business Telephone Call Recording

Businesses can monitor calls related to their primary business. If the phone call is being recorded for purposes such as market research or customer service quality control, then the other party must be informed before recording commences.

    Protect Yourself

When using telephone call recording equipment check your state legislation. There are various types of telephone call recorders on the market today. You can use the latest state-of-the-art equipment to record your most important telephone calls and protect your interests.

  2. y are you worried if you are being recorded?

jusdt be careful what you say and you'll be fine

  3. there is NO WAY to know if you are being recorded if no one tells you that you are being recorded.

if you call the police, they place a beep on the line every 10 seconds to indicate they are recording.

if you call a business, they announce they "maybe recording for customer service and training"

if you call me, I record all calls, I do not tall anyone, I am perfectly legal to do so, I just cannot use the recording in court, but once the person that challenges knows I have them on tape, the issue gets dropped.

  4. MOST states only require ONE person to consent to the recording.. so if the other person you are talking to is the one doing the recording you have no say in if the conversation will be recorded or not... unfortunate but true... always be careful of what you discuss on the phone... and always expect that the other person is recording the call..

and what you say on a phone call if recorded can be used in court as long as the state that the recording was made and where you are have single party consent laws
