Question:

I know the judge! whats going to happen?

i'm contesting a traffic violation (california) and the judge i was assigned is a man i know very well...

any idea of what will happen? will it be dismissed? will i be reassigned?

  1. No you should not get off. That would be unfair to all the others who are there for the same reason.


  2. Since the judge knows you well the judge is legally required to have your case reassigned to another court.  If the judge hears your case he could be heading for trouble.

  3. If he recognizes your name, he will usually request for a change due to  a conflict of interest.  He can get in big trouble if he dismisses etc because he knows you.

  4. Well, if he dismissing it because of knowing you, thats illegal and he could and should be tried for that.  If he dismisses it due to lack of evidence, then thats better, and legal.

    The problem is that is this a case, or you just pleaded not guilty to a traffic violation, and got a court date?  If this is a case, then you find a lawyer, and suit up for the worst.  Make sure you have proof (whether video, pictures, etc.).  If this is not a case, then you most likely will wait for 3-4 hours in the court room, and then once they call your name, they will state your charge and make you pay the fine...(It's like you can't say no...they state it so demandingly. lol).

  5. HE SHOULD STEP DOWN AND ALLOW ANOTHER JUDGE TO HANDLE IT. IF NOT AND HE FOUND IN YOUR FAVOR HE COULD BE REMOVED FROM THE BENCH PERMANENTLY

  6. It depends on your relationship with the judge.  If he likes you, go for it.  Hopefully he'll let you off with a warning.  If he doesn't like you, tell the court that you know him personally and that it is a conflict of interest for him to preside over your case.

  7. If you are NOT reassigned, the Judge should be removed.
