Question:

I left the parking lot after she hit my car

I was backing up and saw the car behind me moving too. I honked but she continued and hit my car. We both pulled back into our parking slots and then got out to check for damages. She just had a minor scratch to her bumper, mine has a small dent or tear. I was very upset and figured that I just didn't want to deal with it even though she clearly didn't stop when I honked. Clearly it was her fault. She should have stopped when I honked. So like I said, I was very mad and upset but figured I would just let it go. So I told her, "look... forget it, you've hit my car and did some damage and you only have a minor scratch, I'm not dealing with this. Have a great day." and I left. Well I drove for about 1 block and I decided to go back but saw that she was gone. I called my insurance agent and told her the incident. So here I am waiting to see what will happen. I am not sure what to do. I left the so called crime scene even though I know it was her fault but I did wrong anyways. I don't know what to do now. I'm hoping this will all go away.

  1. Your indecisiveness has closed off your options.

    You left the scene, you didn't exchange any information, and you didn't record the other driver's license plate number.  Face it, you have no way to proceed if you want the other driver to answer for expenses.

    That means it's all on you.


  2. you need to learn to be a defensive driver. you think honking is going to make some one stop? you have to take control of the situation and protect yourself and your vehicle. if you saw her, why on Earth did you keep backing up? i think you have road rage and you wanted her to hit your car, just so you could get into a fight about it. Thats the only explanation I can think of. Next time, take responsability for yourself. You cannot always count on the other person seeing you or stopping for you.  

  3. You should taken down her insurance information, it is likely that now YOU will have to pay the deductible to cover the damages to your car.

  5. Depends on your states laws. Some have a statute on private property accidents. Some don't and only address accidents on public roadways. You were backing, so you were in the wrong, no matter what she "should" have done. So probably nothing will happen, other than your insurer covering the damage less the deductible, if you have collision coverage.

    you didnt have the right of way you were entering her lane. you should have stopped moving backwards and pulled forward

    she didnt have to stop for you

    it wasnt her fault she left case closed you got off lucky next time dont be soo stupid and get your drivers manual out you need to learn about right of way

  9. Its not her fault.  Anytime your backing out of a space it is your fault no matter how fast, slow, medium speed the person was going!!  (Just like when your turning left)

    Also, after you leave an accident without getting information your screwed so there is nothing you can do.  Suprised your agent didn't tell you all this!!  Plus, really it is common knowledge!!
